These terms and conditions of use (hereinafter referred to as the "Terms and Conditions") apply to the use of the MILITARIA 1911 Online Store. :Article 3 (Management of User ID and Password)

:Article 4 (Sales Contract)

Minebea may terminate the purchase agreement described in the preceding paragraph without prior notice to the user in the event that any of the following events occurs

 

If the user violates these Terms of Use.

When the delivery of goods is not completed because the delivery address is unknown or the user is absent for a long period of time.

In the event that the Company deems that the relationship of trust between the Company and the user has been damaged.

 

The method of payment, delivery, cancellation of purchase orders, return of products, and other matters related to this service shall be determined separately by the Company.

 

:Article 5 (Intellectual Property Rights)

Copyrights and other intellectual property rights to product photos and other content (hereinafter referred to as "Content") provided through the Service belong to the Company and other legitimate right holders such as Content providers, and users may not reproduce, reprint, modify, or make any other secondary use of the Content without permission. Product photos may be used for secondary use only with permission of the Company, and the Company will charge a reasonable amount of money for any economic loss incurred due to undeclared use.

 

:Article 6 (Prohibited Matters)

In using the Service, the User shall not engage in any of the following acts

 

Any act that violates laws and ordinances or public order and morals

Actions related to criminal acts

Acts that infringe on copyrights, trademarks, or other intellectual property rights contained in the Service.

Acts that destroy or interfere with the functions of the Company's servers or networks.

Commercial use of information obtained from this service

Actions that may interfere with the operation of our services.

Acts of unauthorized access or attempts to gain unauthorized access

Actions that impersonate other users.

Actions that directly or indirectly provide benefits to antisocial forces in relation to our services.

Actions that aim to overthrow society, such as political activities.

Actions for the purpose of manufacturing copies of the Company's products

:Article 7 (Suspension of the Service, etc.)

Militaria 1911 reserves the right to suspend or discontinue provision of all or part of the Service without prior notice to the User for any of the following reasons

 

When maintenance, inspection, or updating of the computer system related to the Service is performed.

In the event that provision of the Service becomes difficult due to force majeure such as earthquakes, lightning, fire, power outages, natural disasters, war, etc.

When computers or communication lines are stopped due to accidents.

When Militaria 1911  judges that it is difficult to provide this service.

When the Company is not responsible for any disadvantage or damage incurred by the user or a third party due to the suspension or interruption of this service, regardless of the reason.

 

:Article 8 (Restriction of Use and Termination of Registration)

We reserve the right to restrict the use of all or part of the Service or terminate a user's registration without prior notice in any of the following cases

 

In the event that a user violates any of the provisions of these Terms of Use

When it is found that there is a false fact in the registration information.

In the event that a user's credit card is suspended as a means of payment.

In the event of default in payment of fees and other obligations.

When there is no response from us for a certain period of time.

When there has been no use of the Service for a certain period of time since the last use of the Service

Militaria 1911 shall not be liable for any damages incurred by users as a result of actions taken by Militaria 1911 in accordance with this Article.

 

:Article 9 (Withdrawal from membership)

The User may withdraw from the Service through the prescribed withdrawal procedure.

 

:Article 10 (disclaimer of warranty and disclaimer of liability)

The Company does not warrant that the Service will be free from defects in fact or in law (including, but not limited to, defects in safety, reliability, accuracy, completeness, validity, fitness for a particular purpose, security, etc., errors or bugs, or infringement of rights). We do not warrant that the Service will be free from defects (including, but not limited to, errors, bugs, infringements of rights, etc.).

We shall not be liable for any damages incurred by the user as a result of this service. However, if the contract between the Company and the user regarding the Service (including this Terms of Use) is a consumer contract as defined in the Consumer Contract Act, the Company shall not be liable for any loss or damage arising out of the use of the Service. However, this disclaimer does not apply if the contract between the Company and the user regarding the Service (including this Agreement) is a consumer contract as defined in the Consumer Contract Act, but even in such a case, the Company shall not be liable for default or tort due to the negligence (excluding gross negligence) of the Company. However, even in such a case, the Company shall not be liable for any damage arising from special circumstances (including cases where the Company or the User foresaw or could have foreseen the occurrence of damage) among damages caused to the User due to default or tort caused by the negligence (excluding gross negligence) of the Company. (2) We shall not be liable for any damages arising out of special circumstances (including cases in which we or the user foresaw or could have foreseen the occurrence of damages).

We are not responsible for any transactions, communications, or disputes between a user and other users or third parties regarding the service.

 

:Article 11 (Change of Service Contents, etc.)

The Company may change the contents of the Service or discontinue providing the Service without notice to the User, and shall not be liable for any damages incurred by the User as a result of such changes or discontinuation.

 

:Article 12 (Modification of Terms of Use)

The Company may change the Terms of Use at any time without notice to the User, if the Company deems it necessary. In the event that a User starts using the Service after a modification of the Terms of Use, such User shall be deemed to have agreed to the modified Terms of Use.

 

:Article 13 (Handling of Personal Information)

The Company shall appropriately handle personal information obtained through the use of the Service in accordance with the Company's "Privacy Policy.

 

:Article 14 (Notification or Communication)

Notification or communication between a user and Militaria 1911 shall be made in a manner determined by Militaria 1911. Unless a user notifies us of a change according to a method separately determined by us, we will assume that the currently registered contact address is valid and send notices or communications to that address, which will be deemed to have reached the user at the time of transmission. Even if the user has not received the notice or communication due to technical or skill reasons, the communication will be deemed to have reached the user as long as it has been sent.

 

:Article 15 (Prohibition of Assignment of Rights and Obligations)

The User may not assign its position under the Service Agreement or its rights or obligations under this Agreement to any third party or offer them as security without the prior written consent of the Company.

 

:Article 16 (Governing Law and Jurisdiction)

This Agreement shall be governed by and construed in accordance with the laws of Japan. The United Nations Convention on Contracts for the International Sale of Goods shall not apply to the Service.

In the event of any dispute arising in connection with the Service, the court having jurisdiction over the location of the Company's head office shall be the court of exclusive jurisdiction.

 

:Article 17 (Change of Exchange Rates and Prices)

Militaria 1911 reserves the right to change product prices and foreign currency prices based on exchange rates at any time without notice to the user, if deemed necessary. In the event that a User starts using the Service after a price change based on an exchange rate or a domestic price change, such User shall be deemed to have agreed to the changed price.
